Rental Terms

These terms govern the relationship between the operator of the rental service (the lessor) and the customer (the lessee) when renting e-scooters. By taking possession of the scooter, the lessee confirms that they have read and agree to these terms.

I. Contracting Parties and Subject Matter

The lessor is eMobility s.r.o., IČO 54872286, with its registered office at Radlinského 12, 080 01 Prešov, place of business Jarková 6, 080 01 Prešov (hereinafter the "lessor"). The lessee is a natural or legal person who reserves and takes an e-scooter into temporary use from the lessor (hereinafter the "lessee").

The subject matter of the rental is an e-scooter, including the accessories handed over at pick-up. The rental contract is concluded when the lessee takes possession of the scooter and pays the rental price and the refundable deposit.

II. Subject of the Rental and Accessories

The lessor provides Kugoo e-scooters for rent (models G2, G3 and G4). The rental price includes:

• a protective helmet,
• a charger,
• a map with a recommended route based on the type of ride,
• an introductory briefing (in Slovak, English or German).

The scooter is handed over clean, fully charged and in operational condition. The lessee is obliged to return the scooter in the same condition, with normal wear and tear corresponding to the duration and manner of use.

III. Rental Price, Deposit and Payment

The rental price is 50 € per week per scooter, the same for all models. The minimum rental period is one week.

Upon taking possession of the scooter, the lessee pays a refundable deposit of 100 € per scooter. The deposit serves to cover any damage, loss of accessories or delay in returning the scooter, and is refunded in full once the scooter is duly returned in the agreed condition.

The rental price and the deposit may be paid in cash, by bank transfer or by payment via QR code. The rental price is due upon taking possession of the scooter, unless agreed otherwise.

IV. Rental Period, Pick-up and Return

The rental period is agreed upon at the time of reservation and begins when the scooter is taken into possession. The lessee is obliged to return the scooter no later than on the agreed date and time at the lessor's place of business (Jarková 6, Prešov), unless agreed otherwise.

The condition of the scooter is checked both at pick-up and at return. In the event of a delay in returning the scooter without prior agreement, the lessor is entitled to charge a proportionate part of the rental price for each commenced day of delay, or to set it off against the deposit.

Returning the scooter before the end of the agreed rental period does not give rise to any claim for a refund of a proportionate part of the rental price.

V. Rights and Obligations of the Lessee

The lessee is obliged to:

• be older than 18 years and to present a valid identity document when taking possession of the scooter,
• use the scooter solely for the purpose for which it is intended and in accordance with the road traffic rules in force in the Slovak Republic,
• wear the provided protective helmet while riding,
• not operate the scooter under the influence of alcohol, narcotics or psychotropic substances,
• not exceed the maximum permitted load capacity of the scooter and not carry additional persons on it,
• protect the scooter against damage, loss and theft, and to secure it when parked,
• not hand the scooter over for use by a third party without the lessor's consent,
• not carry out any interventions, repairs or modifications to the scooter.

VI. Liability for Damage, Loss and Theft

The lessee is liable for damage to the scooter and accessories arising during the rental period beyond normal wear and tear, as well as for the loss of the scooter or accessories. The lessor is entitled to set off any damage incurred against the deposit paid; if the damage exceeds the amount of the deposit, the lessee is obliged to pay the difference.

In the event of theft or loss of the scooter, the lessee is obliged to report this fact without delay to the lessor and to the Police of the Slovak Republic. The lessee is liable for damage caused to third parties during the operation of the scooter throughout the rental period.

VII. Reservation and Its Cancellation

A reservation can be made by phone or by e-mail. The lessor and the lessee may agree to cancel or amend the reservation. The lessor reserves the right not to carry out the reservation if the lessee fails to meet the conditions under these terms (in particular age, identity document, payment of the deposit).

VIII. Protection of Personal Data

The lessee's personal data is processed to the extent necessary to conclude and perform the rental contract. Details about the processing of personal data can be found in the Privacy Policy section.

IX. Final Provisions

Matters not governed by these terms are governed by the relevant provisions of Act No. 40/1964 Coll., the Civil Code, and by other generally binding legal regulations of the Slovak Republic. The lessor reserves the right to amend these terms; the current version is always published on this website.
