This policy explains how the e-scooter rental operator processes and protects your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
I. Basic provisions
The controller of personal data under Art. 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the "GDPR") is eMobility s.r.o., IČO 54872286, with its registered office at Radlinského 12, 080 01 Prešov (hereinafter the "controller").

Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to a certain identifier, such as a name, an identification number, location data, a network identifier, or by means of one or more specific factors.
The controller has not appointed a data protection officer.
II. Sources and categories of processed personal data
The controller processes personal data that you have provided to it, or personal data that the controller obtained in connection with handling your reservation and concluding the rental agreement.
The controller processes your identification and contact data and data necessary for the performance of the rental agreement (including data from an identity document required to conclude the rental agreement and to secure the refundable deposit).
III. Legal basis and purpose of processing personal data
The legal basis for processing personal data is:
- performance of the agreement between you and the controller under Art. 6 para. 1 point b) GDPR,
- the controller's legitimate interest in providing direct marketing under Art. 6 para. 1 point f) GDPR,
- your consent to processing for the purposes of providing direct marketing under Art. 6 para. 1 point a) GDPR in the event that no service was ordered.
The purpose of processing personal data is the handling of your reservation and the exercise of rights and obligations arising from the contractual relationship between you and the controller; when making a reservation and renting, personal data are required that are necessary for the successful conclusion and performance of the rental agreement (name and address, contact, identity document). The provision of personal data is a necessary requirement for concluding and performing the agreement; without the provision of personal data, it is not possible to conclude the agreement or for the controller to perform it.
No automated individual decision-making within the meaning of Art. 22 GDPR takes place on the part of the controller.
IV. Data retention period
The controller retains personal data:
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims under these contractual relationships (for a period of 15 years from the termination of the contractual relationship),
- until the consent to the processing of personal data for marketing purposes is withdrawn, at most 3 years, where personal data are processed on the basis of consent.
After the expiry of the personal data retention period, the controller will erase the personal data.
V. Recipients of personal data
Recipients of personal data are persons:
- involved in carrying out payments and providing the service under the agreement,
- ensuring the operation of the website and other related services, including marketing services.
The controller does not intend to transfer personal data to a third country (outside the EU) or to an international organisation. Recipients of personal data in third countries are cloud service providers.
VI. Your rights
Under the conditions set out in the GDPR, you have:
- the right of access to your personal data under Art. 15 GDPR,
- the right to rectification of personal data under Art. 16 GDPR, or restriction of processing under Art. 18 GDPR,
- the right to erasure of personal data under Art. 17 GDPR,
- the right to object to processing under Art. 21 GDPR,
- the right to data portability under Art. 20 GDPR,
- the right to withdraw consent to processing in writing or electronically to the address or e-mail of the controller specified in Art. I of these terms.
You also have the right to lodge a complaint with the Office for Personal Data Protection in the event that you believe your right to personal data protection has been violated.
VII. Conditions for securing personal data
The controller declares that it has taken all appropriate technical and organisational measures to secure personal data, including technical measures to secure data storage and storage of personal data in paper form. Only persons authorised by the controller have access to personal data.
VIII. Final provisions
By submitting the contact form or a reservation, you confirm that you are familiar with the personal data protection terms and that you accept them in their entirety.
The controller is entitled to amend these terms. It will publish the new version of the personal data protection terms on its website.
